Terms of Use ​

Please read these Terms of Use ("Terms") carefully before using the DevDiff CLI, Gateway, VS Code Extension, Open VSX Extension, and associated open-source packages (collectively, the "Software").

1. Agreement to Terms ​

By downloading, installing, or using the Software, you agree to be bound by these Terms and the MIT License under which the Software is distributed.

If you do not agree to these Terms, do not install or use the Software.

2. License & Open Source ​

The Software is licensed under the MIT License.

You are free to:

  • ✅ Use the Software for personal and commercial purposes
  • ✅ Copy, modify, and distribute the Software
  • ✅ Sublicense the Software
  • ✅ Use the Software in private or proprietary projects

Subject to:

  • 📋 Including the original copyright notice and MIT License text in all copies
  • 📋 Not holding the authors liable for damages arising from use

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

3. Responsible Use of AI Providers ​

DevDiff connects your local code repositories with local or cloud AI models.

  • You are solely responsible for all API usage costs incurred on third-party cloud providers (OpenAI, Anthropic, Google Gemini, etc.) resulting from running DevDiff.
  • You agree to comply with the terms of service and acceptable use policies of any third-party AI provider you configure.
  • You must not use DevDiff in ways that violate applicable laws, export control regulations, or AI provider usage policies.

4. Prohibited Uses ​

You agree not to:

  • Use DevDiff to generate or distribute malicious code, malware, or harmful content
  • Attempt to bypass or circumvent DevDiff's security controls (Injection Guard, Redaction Engine, Network Guard)
  • Use DevDiff to process or transmit data belonging to others without their authorization
  • Misrepresent your affiliation with DevDiff or the DevDiff project

5. Intellectual Property ​

The DevDiff name, logo, and associated brand assets are the intellectual property of Eldrex Delos Reyes Bula. The source code is open source under MIT but the branding is not licensed for use in derivative products without explicit written permission.

6. No Warranty ​

The Software is provided free of charge and "as is". We make no warranties regarding:

  • Uptime or availability of documentation services
  • Fitness for any particular purpose
  • Accuracy of AI-generated changelog outputs

7. Limitation of Liability ​

Under no circumstances shall the creators, maintainers, or sponsors of DevDiff be liable for any direct, indirect, incidental, special, or consequential damages — including loss of data, profits, or business interruption — arising in any way from the use or inability to use the Software.

8. Third-Party Services ​

DevDiff integrates with third-party services at your direction (Ollama, OpenAI, Anthropic, Slack, etc.). We are not responsible for the availability, security, or terms of those services.

9. Governing Law ​

These Terms are governed by and construed in accordance with the laws applicable in the user's jurisdiction. Any disputes will be resolved in accordance with those laws.

10. Changes to These Terms ​

We may update these Terms when the Software's scope or policies change. Changes will be published to this page with an updated "Last Updated" date and tracked in git history.
